Terms of Service

This document is a public offer (“Offer”) and sets the terms of using the Tallker service (“Service”), available at https://tallker.com/.

The Operator offers to enter into an agreement with any person using the Service (“User”) by accepting this Offer.

Terms and definitions

• Operator — the entity providing the Service: Individual Entrepreneur Arziani Vinari Vinarievich.
• User — the person using the Service (typically a legal entity or sole proprietor), as well as authorized employees/operators of the User.
• Account — a user account in the Service and its related configuration (sites, operators, channels, settings).
• Widget — a client-side component (script/widget) for the User’s website through which visitors send inquiries.
• Inquiry/Dialog — communication between a website visitor/customer and the User’s operators via the Service.
• Plan — a set of features and limits of the Service provided for a fee or free of charge.

Subject of the Offer

The Operator provides the User with access to Tallker functionality under the SaaS model (software as a service), and the User accepts these terms, agrees to follow the Service rules and pay for the selected plan (if applicable).

Acceptance of the Offer

Acceptance of the Offer means performing any of the following actions:

• registration in the Service;
• installation/use of the Widget on the User’s website;
• payment for a plan or obtaining access to paid functionality by any means;
• actual use of the operator dashboard, integrations or API.

By accepting, the User confirms they have the necessary authority and legal capacity to enter into the agreement.

Registration and account

• The User provides accurate information during registration and keeps it up to date.
• The User is responsible for the security of credentials (login/password) and the actions of employees who have access to the Account.
• The Operator may apply security measures (checks, limits, blocks) if there is suspicion of compromised credentials or abuse.

Functionality and usage limitations

General rules

• The Service may only be used for lawful purposes and in compliance with applicable law.
• It is prohibited to use Tallker for spam, phishing, malware, deception, or any other abuse.
• Hacking attempts, bypassing limits, interference with Service operation, DoS/load attacks, and vulnerability scanning without consent are prohibited.

User data and content

• The User decides what data is transmitted to Tallker via the widget/integrations/API.
• The User warrants they have legal grounds to transfer personal data of customers/visitors (e.g., notice/consent where required).
• The User is responsible for the content of messages and attachments sent via Tallker.

Availability

The Operator aims to ensure stable operation of the Service; however, downtime for maintenance, updates and incident response may occur. Support regulations may differ by plan.

Pricing and payments

Current plans and terms are published on /pricing .

• Payments are made in advance for the selected period unless agreed otherwise.
• Payment is deemed made when funds are received/confirmed by the payment system.
• Refunds and recalculations (if applicable) follow plan rules and consider services already provided.

Support and communications

• Support is provided via the channels listed on the contacts page: /contacts.
• The Operator may send service notifications to the User (security, feature changes, incidents).
• The User agrees to receive emails/in-app messages necessary to perform the agreement.

Intellectual property

• Exclusive rights to the Service, code, interfaces, design and documentation belong to the Operator.
• The User receives a limited right to use the Service within the selected plan for the term of the agreement.
• The User retains rights to their content and data transferred to the Service to the extent provided by law.

Data and privacy

The procedure for processing personal data is described in the Privacy Policy .

• The User must inform customers/visitors about the use of the widget and the transfer of data to Tallker.
• The User must not transmit excessive or prohibited data, or information whose distribution violates third-party rights.

Liability

• The Service is provided “as is” to the extent permitted by law. The Operator does not guarantee uninterrupted operation or absence of errors.
• The Operator is not liable for actions of third parties (payment systems, telecom providers, hosting providers, etc.) outside the Operator’s reasonable control.
• The Operator is not liable for consequences of the User’s use of the Service, including message content, data correctness, and compliance with law.
• The Operator’s total liability is limited to the amount paid by the User for the last paid period (unless mandatory law provides otherwise).

Term and termination

• The Offer is effective from acceptance and for the period the User uses the Service.
• The User may stop using the Service at any time, subject to paid period terms and plan rules.
• The Operator may suspend/limit access for violation of terms, law requirements, or threats to security/stability.

Changes to the terms

The Operator may change the Offer terms. A new version takes effect upon publication at https://tallker.com/terms.

Dispute resolution

• The parties aim to resolve disputes through negotiations and support correspondence.
• If a dispute is not resolved, it is subject to applicable Russian law at the Operator’s place of registration, unless otherwise required by law.
